Got a quick question: Which credit card says priceless... is it Discover Card or visa? Thanks in advance for any response. Another question... Back when I was in college I got a credit card, I had a decent job working part time which I eventually lost. I got behind on my payments and eventually let it go. Well time past and the phone calls continued to come, of course I ignored them for the most part. |

Your next step should be to go to annualcreditreport.com and get FREE hard copies of all three of your credit reports. Review them to see what is reported. After you know what is reported come back here and post your questions. There are many experts here who can help you determine the actions necessary to clean up your reports... |

Okay I went and got my credit reports, it shows the Bank of America card as purchased by another lender, and obviously it shows as a negative account. I tried disputing it in the past but got no where. I figured since the company that purchased the debt couldn't provide the proof of the debt, that this could be taken off my credit report...

You need to contact the court clerk and find out how your case was dismissed. If it was dismissed without prejudice then the debt may still be considered valid..
How old is this debt? Is it in or out of SOL?.. |

The dates on your CR may or may not be accurate. When was the Date of First Delinquency on these accounts? Depending on your state, thats either the date of your last payment or the date it was declared past due...

I'm not sure, do you know how I could find that information out? The last time I tried contacting BofA they didn't have any record of my account...

You need to get verification of the debt from the third-party collector that now owns your debt. In your request, you need to specifically ask what the date of first delinquency is. The date of first delinquency usually starts the Statute of Limitations. Once the Statute of Limitations has expired, the debt collector/creditor can no longer file a claim against you. For example, in Texas, a debt collector/creditor only has four years from the date of the first delinquency to file suit. I would advise you to find out what the Statute of Limitations is for your particular state...

I haven't found out the date yet but I did find this website that says it is three years for South Carolina..

I spoke to my attorney and he told me that when everything is finished (the dismissal of the case), that I will be able to have everything removed. Do you think he is correct? I wouldn't normally question him, but he is a good friend and sometimes he doesn't pay a lot of attention to what I'm trying to say, especially why he is at work and since I don't have to pay him...

Again, the key is...was it dismissed with or without prejudice....that is a big part of your question...
