First of all What is the best marketing for getting Lending Tree mortgage leads? Many thanks for any response. Second question.. Got behind in my payments to Providian, bla, bla, bla... Account went to a collection agency called Nationwide credit, Inc. the amount I owed Providian was 1832.30, Nationwide Credit settled with me for $920.00... Paid Nationwide the $920.00, got my settlement letter, thought the whole mess was finished - NOT! a few weeks ago a collection agency called FMS started calling me on a over due Providian account. |

I'm stumped. I'm not so sure what is the right answer to your question. I'll do some research and get back to you if I bump into an answer. You should email the people at Lending Tree as they probably could give you an answer..

I wonder if you had a letter from Providian or CA #1 that the settlement meant the debt was paid in full, if you could use that as proof that the debt was paid?.
Proof for both CA #2 and the CRAs to make the appropriate changes.. Not sure if that would work .... Peace,. Delilah.. |

Here's what I'd do:.
1: Tell both the CA and OC to screw themselves and sue me.. 2: Trot out the Settlement Letter and Cancelled Check in court and show them to the judge.. 3: Be sure to countersue for Breach of Contract, Loss of Consirtium, General Aggravation and anything else I can think of... |

Call the 1st CA, be very nice, get them to admit in writing that the debt was settled in full for $920. Even though it's after-the-fact, it may help. Worth the try...

No. They are reporting that I still owe $1323.00. I have canceled check, settlement letter, and all paperwork from both collection agencies...

When we (Re CA) make the purchase or servicing transaction, we receive a power of attorney that gives us the inherit rights under the original cardholder agreement. We have the ability to "bind" the original creditor in certain situations. This gives us the right to settle an account and REQUIRE that the original creditor, such as Citibank, MBNA, Household etc. remove the original trade line and OURS..

Providian is just about a whole bunch of a**holes!.
I'm up late tonight working on getting research towards my wife's Providian account. She has an acct. from back in 2000 that once had a balance of around $1400. She somehow got behind in paying the acct. and was hassled into doing the check-by-phone payment plan. What is fishy is that there was a different company (Allied Interstate) that would be the ones calling every 3 months to do the check-by-phone. What I'm searching for is a sample letter I can send them demanding they send me all the proof that adds up to that balance. I've already filed a Dispute with Equifax CRA.. Thanks!. Rudy.. |

First of all it really don't take any fancy letter to do that. I have yet to figure out why it is that folks seem to think it has to be some high powered lawyer sounding thing.. But either way, you get some letter that looks like it was written by Dewey Cheatum & Howe Inc. or you just write something simple and let us say that you get what you ask for. What will you do then?.. |

Ok, so where do I go with this then?.
Simple story. They say my wife owes; I say she paid!. Do I let them continue to pester us,,, or what?. We pulled my wife's CR from Equifax, then filed an Online Dispute via their website, claiming that the "balance owed is incorrect".. We filed that dispute earlier this week, yet she still got a phone call this morning from Providian, with the CSR stating he has nothing stating we're disputing the debt.. Should I pull a CR from the other 2 CRA's, and then also file an online dispute with each? or is disputing with 1 CRA enough?. I have a feeling that Equifax will contact Providian, asking them to validate; at that point Providian will simply give Equifax a computer printout showing my wife's acct info & her inaccurate balance total.. I'm not trying agrue anything with any of you'all here; I've come to this website seeking knowledge & I'm gaining it here!. I appreciate everyone's input here!. Sincerely,. Rudy.. |

Actually, Efx will not ask Providian to validate, they will simply ask them if it is correct or not, and Providian WILL say yes. The bureaus do not in any way ask a creditor to prove something, only if it is true or not...

Okay, I missed this part. I think that you should write Providian, include a copy of this letter, tell them to make the proper changes to how they are reporting (which they should have done long ago)..
Send the new CA a cease and desist, based on the account already being settled.. If Providian does not comply, SUE THEM!. If the ne CA does not comply, SUE THEM TOO!.. |

All I can say is that before you go sending any Cease & Desist letters you had best have conclusive proof that you paid them and that the amount you paid is exactly the same as the amount they are claiming that you owe otherwise they just might do exactly what you are asking them to do with a C&D which is to sue you. If you don't have that proof or can't get it you will be very likely to wish you never heard of any silly Cease & Desist letter..

Back in 2000 I got behind in my Providain account...long story short, Providain closed my account and sold it to a collection agency called Nationwide Credit, Inc. the amount I owed Providian was $1832.30 - In October 2002, Nationwide offered me a settlement for $920.00, I paid Nationwide the $920.00 and they sent me a settlement letter. Today I get my three credit reports and Providian is still reporting a balance $1095. I have copies of my settlement letter, and my cancelled checks. Can I dispute this with the credit bureaus? Is there a letter for this? My question is how can I get this removed from my credit reports? I feel that Providian is reporting inaccurate information...

I think that you can. You seem to have the proof that the debt was paid. Send copies of the letters and cancelled checks both to Providian and the CRAs, along with strongly worded letters about how this debt was settled and should not be showing up on your reports this way. I don't think you need any fancy letter ... let the documents do most of the talking..
But my question is this could it possibly be that yes, they deducted that $920 from the original $18XX, but the balance showing now is the remainer plus whatever bs fees they have tacked on?. Maybe they are trying to report a collection on the remainder of the balance, saying that your settlement did not pay the debt in full?. I still think that the letters that you have could be proof that they should not be reporting anything else, depending on the wording.. Peace,. Delilah.. |

I think that is what happen. I think that Providian is still trying to collect on this debt. BUT, I do have a settlement letter from (Nationwide) - the first collection agency. A new collection agency is now in the picture. I faxed them the settlement letter and they haven't called since. I just got off the phone with Providian - I just got the major run around, bla,bla,bla... give me your information and we will look into it crap! I need the right letter to send to the CRA's...

I can well understand how that could have happened. You see, as we so often tend to believe, there are probably a few good collectors out there who at least make an honest attempt to do things the right way. And as always there are also at least a few bad apples out there. So just for purposes of conversation let us assume that you got turned over to one of the bad ones..
Now then, what things might a bad collection agency do? Do you think it's possible that some collection agencies collect money and then fail to tell their customers that they collected the money from the debtor in order to increase their profits? Would you believe that could happen?. If not then I must ask you why it is that so many states make collection agencies report the amount of money they hold in their accounts and have not yet paid to their customers and who those customers are? And could you believe that the collection agency you paid never paid Providian so now Providian is after you for the money they never got paid by the collection agency?. Good!. OK.. There isn't any right letter to send to the CRAs. What you need to do is to send Providian a copy of the letter from the first collection agency you paid and see if that won't help you. If it don't then it may be in your best interest to take other actions.. Make sense?.. |

Well then I would suggest that you attempt to prove that to Providian and let them go chase the collection agency...
