Got a quick question: Need advise on a Lending Tree mortgage quote, is 4% good? Thanks in advance for any comment. Another quick question... I have been shopping for a new car this week, and took a visit to the local Nissan dealer to check out the new 350z..

Since this is a 'in demand' car they require a credit check before allowing a test drive(Total BS). I informed them that I already had a Lending Tree loan approved well over the amount of the car, and I did not want a report pulled for any reason. I showed them my Lending Tree loan 'dealer paperwork', and they seemed ok with that..

So when we started dickering on the price of the car, they started showing me monthly payments etc. At this point I became very suspicious and told them they had no clue what my payments would be since they dealer docs they saw did not mention any terms of the loan. After talking some more I realized they must of pulled reports, since they slipped a few details they could not have known otherwise. They also mentioned details about my Father also (I am a Jr.) - so I guess they were able to do this with name only and no SSN..

At this point I was livid, and basically walked out..

I now have 5 hards (total) on EQ and EX, haven't checked TU yet..

I realize this is typical slimy car sales BS, but it is illegal, an I feel really violated about it. Not to mention my Dad may now have several Inqs as well..

Any Advice on where to start? I really do not care about personally profiting from this, but I want these slimebags to pay any fines, legal fees etc.. that I can come up with. Please let me know your thoughts. My current plan is to contact the FTC, State AG, and Nissan to tell the story. Any other suggestions?..

I'm stumped. I'm not so sure what is the right answer. I'll do some poking around and get back to you if I bump into an useful answer. You should email the people at Lending Tree as they probably could give you an answer..

Everything you need to quote to them is found in this FTC opinion letter:.

Specifically this section:.

You came with your own financing already pre-arranged, which makes you just about the same as a cash customer, IMO. I'm assuming you didn't sign anything, which means that PP has definitely been violated..

I say report them to the FTC, AG, and BBB. Send them a letter, and even if you aren't after the cash - make them pay up anyway. It's really the only way they'll learn their lesson, and you'll have to finance $1000 less on that new car ;-)..

This is what I do when I'm getting the new car itch.....

1.) Make a copy of my drivers license..

2.) Write on the copy of the driver's license "YOU ARE NOT AUTHORIZED TO PULL A CREDIT REPORT!!".

3.) If the dealers asks to see my originial DL I show it to them, I never give it to them..

This dealership is scum and needs to be put in it's place!!!! They have screwed others out of thousands, because of the damages they have done to their credit report, in addition to feeding off of a CR to judge how much they can rape a person by telling them..."well this is the best we can offer you due to your credit history, by taking this car loan, you'll be helping reestablish...blah...blah...blah You get the point. I would be there first thing in the morning throwing one of my infamous "hissie fits" as my wife likes to call them, until something is done about it..

I bought their book, and it has really opened my eyes to how slimy car dealerships are. I always thought it was only the little "Buy here Pay Here" joints that were really bad - not the case at all..

Very depressing to see all the scams, but I am sure it will save anyone who reads it a ton of money on a car..

I am not disagreeing here - just trying to get the right head for writing the letter - and sharing my current frame of mind. Please let me know what I am missing. Thanks!.

Off the bat, I see no value in this - as I know they will not be able to produce anything (at least not with my signature). To me this just seems like a cost of $5 and a few weeks to mail and wait. I also think it tips my hat a little - I would rather them just get blindsided by the BBB, AG, and FTC. I could understand this approach if I did care about getting a quick hush settlement from them, but that is not my goal here..

Again, not arguing with the point, I just want to get your point of view on why I should do this..

I have never once been asked to show a drivers license to test drive a car.If I am ever asked to do it I will walk away from that dealer instantly...

I can tell you why you should send them a nastygram - the BBB, AG, and FTC.

Won't do anything..

The BBB will.

Say.

They're doing an investigation but they really won't, they'll just take the word of the business and maybe put in their records that it has an unresolved issue - and they don't have the actual power to really do anything punative anyway..

Your state's AG may be the one really great one around, but with complaints from so many people on so many other issues, it's gonna take some time before they get to you..

The FTC doesn't investigate individual cases; it would probably take ~10,000 complaints against that same dealership for them to do anything..

Besides, if you send them something.

Now.

, outlining how the whole evening went while it's still fresh in your mind, they'll know you're serious and your (what's that word, Butch?) notes that were written down as soon as you got home, lol, may just be what they need to change their policies..

They're still doing it because no one has challenged them, Vman. I can completely understand your wanting to do that through the official agencies, it's just that those official agencies won't do anything - better to.

Oh, and if you really want to blindside them, instead of a letter, have them served with a small claims summons..

I'd send them a letter demanding money or they will be sued for violations of law..

If they decide to go the suit route, then sue them..

The judge may be unsympathetic to you. The basis of the suit would have to be a "technical" violation of the law. The judge may agree that they broke the law, but may not agree to award you damages..

So to help you with the damages, you can point out the obious ding on your FICO score. And, also mention that this dealer now has your personal credit information, job information, account numbers, etc in their custody now. How would the judge like it if a salesman pulled his report and learned all his details while browsing for a car? The information is at risk of being stolen and used for idenity theft style fraud..

The FTC opinion letter is great!..

I went thru this situation when I bought the Audi A4 -even though I had a Cap One certificate for financing with me..

They told me that they may get me a lower rate - I took the hit with a total of 3 inquiries. However, they only counted as one inquiry because I bought the car..

I also laugh when I think of that idiot salesman at ALLISON BMW in Mountain View, CA. I CALLED them, told them I would buy a $40K 330ci - then he told me he would run credit before I ever got into that car - he didn't care if I had cash!.

Hehe - the BEST THING I DID in 2002 was buy that A4 - I signed up for Audi track driving school next month..

NEVER FOLLOW....aarrffffff!.

Hmm - it would really frost me if I did not buy a car -.

Car dealers are scum, hit them with a suit asap, screw being Mr. Nice Guy..

The AG, BBB, and FTC won't do anything except see if there are more complaints about the same business.....

Haha - I just bought the book "Sue the Bastards" from Amazon for a gift - it arrived late, so now it is mine, guess this is a great time to read it!..
