First of all Lending Tree mortgage Release Fee of $85 legal in PA? Looking forward for any comment. Another question I got... Has there ever been a class-action lawsuit filed against a CRA??.

It seems they don't like to follow the rules - I was just wondering if people ever got together to call them on it.......

So what happened? Did they roll over for you?.

A CRA is not required to complete an investigation within 30 daysanother "wishful thinker consumer myth" look at the ftc commentary on the fcra and look at the fcra itself. duh..

First of all, when I do get results, those that need to know will be told via email just so you don't know what happened. Secondly, please explain this statement and how it compares to your comments. The investigation needs to be completed within 30 days from the day they received it and they then have 5 days from the 30th day in which to notify the person of the results..

) Reinvestigations of disputed information..

(1) Reinvestigation required..

(A) In general. If the completeness or accuracy of any item of information contained in a consumer's file at a consumer reporting agency is disputed by the consumer and the consumer notifies the agency directly of such dispute, the agency shall reinvestigate free of charge and record the current status of the disputed information, or delete the item from the file in accordance with paragraph (5), before the end of the 30-day period beginning on the date on which the agency receives the notice of the dispute from the consumer...

See the ftc commentary on the fcra, it's also in the statute ("in general")..

Maybe you will see the light...gotta realize that a lot of posters here read the laws in the manner that favors them most. I have posted the whole cite from the ftc commentary thread before, won't do it again..good luck..

Sure, here ya go:.

(taken from "CHOD has Begun" thread) Of course, nobody would dare give this post any credence because it comes from "The Kid" and it is not in keeping with the "wishful thinker" line...forget that it is an official FTC Commentary cited to by courts. LOL:.

The statutory 30 day requirement is not a strict requirement, it is "in general". Look at the first two words of 15 USC 1681i, they are "In general..." Furthermore, the FTC interpretation of 15 USC 1681i states that "...a 'reasonable time' for a particular reinvestigation may be shorter or longer depending on the circumstances of the dispute." 16 CFR Pt. 600, App. So, IMO, we can't hang our hats on the 30 day period...

Here is my argument, now what's your response?.

Dude It's you attitude, and it needs to change pronto. All you have done is alientated yourself from some of the most knowledgeable people in credit reconstruction (not to mention very good people).

There is allot to case law and "interpretation" of the law that you arent grasping, and because of previous posts between you and others, I wont discuss a single credit related issue with you..

I really hope you change your tone here, otherwise EVERYONE here with ignore you and you will soon be arguing with yourself..

I'm done with this..

I bet not ONE of you finds a published case DECISION (not a settlement) where there was liability for not completing an investigation within 30 days...
