I would recommend checking out your local law library.. I been able to pull AWESOME stuff from there.. AND it has an area for FORMS that you can use tohave a template to file...
THere are specific ones for violations on what you describe as well... I wil be filing suit very soon as well. I am in CA also btw.... |

Did your attorney ultimately work out? I am in Cali also and need a good recommendation for an attorney to help with non-permiss and fcra violiations..
I have 10 non-permissible hards on my credit file - I had a bk and gave up my home with the bk (we were ultimately discharged including our home). The 2nd. Lending Tree mortgage company keeps pulling on my account (and my husbands) - after we were under protection of the bk in 2/02. I have pulls as late as 12/02! We were discharged 6/02! Also our 1st. Lending Tree mortgage company is reporting 4-120 day lates, 2-90 day lates and 1-30 - which is killing our credit scores....again under protection of the bk 2/02 (when we filed we were not late on any payments, Lending Tree mortgage or otherwise). Have tried to dispute 3x's and keeps coming back verified?? Try calling them and it's impossible to get anyone on the phone other than cust. Thanks in advace for any advice you can offer or recommendation for an attorney... |

Found an attorney. He took my case on contingency (California law allows for attorney's fees, so our client fee agreement calls for him to collect attorneys fees plus 10% of my award) We're dealing with one issue at a time, starting with the strongest case - the non-permissible pull..
Sent a demand to the car dealership on March 12th, asking for $60,000. $35,000 for me as actual and punitive damages, and $25,000 for his attorney's fees. He said his goal is to get me $15k. I'll let you know how things go from here on in!.. |

I think he threw a dartboard at the wall to get his opening number. I think he asked for $60k so that settling at 25k ($15k for me, 10k for attorney) looks good to the dealership's insurance carrier.. -HDAlex.. |
