Quick question... How does a capital one secured Discover Card work? Hoping for any comment. Another question... Just curiousthis one calls and lets the phone ring twice and hangs up. So I just called back and it gives you the "please hold for a rep" but NEVER states what company they are or anything. Then a live person gets on the phone and says, "this is christy, how may I help you".

We shouldn't be doing that. Are you Mrs. CJF?".

"yes".

"Can I get you to verify your DOB?".

"no".

"your last 4 of your ssn as we have that here on file".

"no".

"well, this phone call can't go any further as we need to verify who you are".

"I just told you my name".

"ya, well...".

"it's amazing how you can get that info just from me calling in from this phone number".

"yes, well this call can't go any further if you won't verify anything".

"well, ok, who is this anyway".

"christy".

"no, what company?".

"oh...so and so".

"hmm ok, can I have your address?".

"Uh, what for?".

"I'm assuming you are a ca since you need to verify stuff".

"It's a personal business matter.".

"really?".

"yes, we can't do our job and we need to do our job but you won't verify".

"well, I need your address. You can put in your notes that I refuse to speak to you on the phone anymore and that I will only be dealing with the OC if this is a valid debt".

"(she laughs) well, that's your choice".

"yes, it is".

Click..

So, my question is, when they call you and then you call them back, not knowing who it is (caller id says :not provided) shouldn't their business line say who they are when you call? Isn't that kinda misleading a consumer into hanging onto the phone and such to find out? Then the rep doesn't even say what company it is unless you ask.......

These are CAs youre dealing with..

There are some legitimate CAs out there that follow the rules and the laws in place..

Unfortunately, they are in a severe minority..

Most CAs are scumbags that will say or do anything they can to get money.

From you, then they trash your credit report and are shocked youre not at their.

Office offering free oral sex for their scumbag practices..

I visited a CA directly to discuss a PFD. (Physical office visit).

I explained that I was ready to satisfy the debt in exchange for a PFD. He refused. I left..

2 weeks later, I got the acct nuked from all reports..

While I'm tempted to fax him (I have his personal fax number) a copy.

Of my hand flipping him the bird, I figured, why worry. I already won.

And best of all, he could have gotten 100% of the money for a delete,.

But since he wanted to be a toughguy, he got 0 AND I still got it deleted..

I love when they shoot themselves in the foot. It truly makes my day.....

The excuse given is that giving the name of a collection company before verifying they are talking to the account owner could be construed as 3rd party disclosure..

I personally just ask for the name and address of the calling company so that I can write them a letter notifying them that they are calling this number in error and must cease and desist...

THAT'S what I was wondering....but by not giving the name up front, like they are required to do on phone messages.....

I'm not looking to go after them, I'm just curious if this is how all of the asbtards are gonna start working.....

I know they have to tell you if you ask...but it was just kinda weird that their automated message when calling them doesn't say who they are...

Maybe it's because they know that as soon as you hear the name you will google them, get their address, and send them a DV/LC&D before they have a chance to talk to you...

If it's automated message then more than likely they're trying to comply with the "3rd party" disclosure...

But in this case, they know, or had reasonable cause to believe, that they DID have the correct person....

They called the phone number (repeatedly), and they also verified the person's name.....

The TCPA would cover their actions when they call you but, not when you call them. Answer their call next time and see how long it takes them to respond after you say, "hello." Im pretty sure the TCPA states the call MUST be transfered to a live person within 2 seconds of the called party answering..

If a CA refuses to tell me who they are when I call back a missed number, I just repeat their questions back to them until they hang up or answer my question...

If you live in a "One Party" wiretapping state, you can legally record the call.

Without telling them. That would give you additional evidence down the road,.

If things.

Get complicated.

Yes, I live in a one party state..

I guess a business isn't required to state the name of their business in their message? I mean, I called them back and of course, when I called, it was like an automated thing...goes straight into, "please hold for the next rep". That was my clue that it was a CA. In the couple of mins I was on hold *cuz you know those reps are busy harassing others* it never once stated what the company was. I just think it's kinda misleading.....

Same with their rep not stating anything about what the name of the company was until askedshe just went straight into "This is christy, is this cfj?" (amazing what technology can do...connect your call to a phone number in their system).

She knew she had the right personI flat out said I was who she was looking for. (I'm not skeered) lol. She just got annoyed when I wouldn't verify anything but my name. Esp if no one is going to say what company they are with. I mean, she seemed to spit out questions fast so that way there wasn't a chance for me to ask what company...kwim? Guess she thought she'd corner me and that's probably how they are trained..

Did I mention I hate auto dialers? whether they are dialing me or I am dialing them....lol..
