If it were me personally I would NOT give them access to my checking account. No way no how..
Can you do one of those pre-loaded debit cards and put the money on there?. And as Jtoast suggested have you made sure this debt is within SOL?. Tying the debt to a pre-loaded debit card is a much better option than giving them access to an actual checking account...

First things first you need to make sure THEY are have the proper validation for the account, send a DV and wait for a response..
How old is this account? When was it charged off?. Texas has alot of good cp laws, not sure how they apply since I have never really dealt with them.... DO NOT give them your bank acct info, I wouldnt even open another acct or do a prepaid debit. There are too many ways they can screw you.. |

The charge off was 10/09. I specificaly asked the "manager" and she stated that Cap one still owns the debt, they are collecting..
Should I call Cap one to make sure that is correct?. This is their first offer so I am hoping it will get better or at least be a while before they sue.. If I take them up on it I would have a seperate account, put only the amount of money for that monthly payment in it and make sure there. Was no way it could be overdrafted.. Does this sound reasonable?. Beli, from what I have read, they pretty much can only put a lien on property here in Texas... |

You need to talk to Cap 1, get in touch with a higher up and see about paying (with Discover card) them directly..
I would Not no way no how give ANY CA access to ANY checking acct. What if they do overdraft you? It can happen even with overdraft protection...i dont trust CAs..... |

Send a letter to the collection agency asking for debt validation. (CMRR).
Then, send a letter to cap1 offering to pay them if they will recall the account from collections... |

If there is no overdraft protection then any transfer that doesn't have propper funds should be declined I would think?. I also thought they were changing the law on this making automatic overdrafts illeagal without it being a specific feature. You pay for on a account... |

ACH doesn't really have an authorization process. The money just comes out I believe..
Don't pay the CA from a checking account. NO DEAL.. Send the DV letter to the CA ASAP... |

Please listen, DO NOT GIVE THEM YOUR CHECKING ACCOUNT, NO MATTER IF IT'S SET UP JUST FOR THIS PURPOSE..
Just because you don't have money in that account, doesn't mean the bank is automatically going to decline it. More then likely what will happen is that they will push the debt through, and you will owe close to 300(payment plus over draft fee, on top of your monthly payments).. I think someone here has a thread that Cap One (or another Discover credit card issuer) keeps taking out different amounts each time they put it through.. Cap one keeps very good records, and seeing this is a recent CO I wouldn't necessarily dv them. I'd talk to cap one and see if you paid them directly through some hardship plan if they'd recall the debt from the CA... |

Don't do it.. No worries. They were very addiment about any deal with payments hinged on access to a account so I knew it wasn't good.... We'll see what happens when I call Cap one. RAB assured me they (Cap one) wouldn't deal with me now and would just send me back over. To them... |
