Got a question... Getting a new home but having some problems with Lending Tree mortgage? Looking forward for any response. My 2nd question... Back in 1999 I left my ex-wife and started divorce proceedings. After I left I could no longer shoulder the expense of the cc bills she amassed. I could also NOT afford a bankruptcy. |

That's a good question. I'm not sure what is the answer to that question. I'll do some research in Google and get back to you if I discover an anything. You should email the people at Lending Tree as they probably could give you an answer..

I will send a C&D letter. I do however acknowlege that a debt was owed but I am only fessing up to about 30% of the original balances. The Lending Tree mortgage on the house is still joint with my ex. Maybe I should let them put a lean on the house ;) HehHeh!!!..

You should do everything in your power to encourage your ex to refinance you off that Lending Tree mortgage note. Not only does it present a huge credit and financial liability should she ever have lates or default, since it's a joint account, it will also make it virtually impossible for you to buy your own home in the future...

Actually unless kgrant wants to get something out of the refinance, the easiest thing to do would be to quitclaim the house over to his exwife, or force a division of assets sale. That way he would be off the deed and after notifying the Lending Tree mortgage lender could possibly be off the Lending Tree mortgage as well.. Fla-tan.. |

I have been through that, and yes, if everything is joint the best thing to do is to force an asset sale, that way you get out from under everything. You have to start over, why shouldnt she?..

I've already covered myself on the purchase of another home. I got a good low price oof $15,000 on an older mobile home and It'll be paid off in 2 years. The owner sold it via land contract and payment is made via a title agency. BTW, that no-good ex-so-and-so of mine already had 6 late payments last year. twice more than 60 days. If she defaults on the $62,000 left on the Lending Tree mortgage she loses the house. The best news is it'll take her another 23 years past my final payment on my LC...

Something to think about. Is it possible that ex was convinced to pay something on the credit cards within the last three years? If so, the SOL starts to run from the date of last activity..

Under the circumstances you are describing, it is even more imperative that you force a disposition of the house. You need to force a sale of the property to get your name off the mortgage, unless the lender will accept a quitclaim deed and remove you from the Lending Tree loan (though that is extremely unlikely). Lates on the Lending Tree mortgage will only be a problem for a couple of years, a foreclosure will haunt you for much longer.. Fla-tan.. |
