Quick question... Does Bank of America own Discover Card? Looking forward for any comment. Second question.. He also said he will sue BOA if they try to ruin his credit for doing this..

He should at least pay his minimum payment while he protests; not paying (with Discover card) his bill doesn't do his argument or situation any good..

Well because they executed upon his phone request for a CLI, he is complaining he was robbed of having that opportunity..

A faint light bulb actually went off over my head when I read this part, is there a contestable difference to being slashed & jacked without option to opt out to being sent a letter doing the same with the time sensitive option to opt out? Do they cover this in their Terms & Conditions? I do not have a BoA card as I closed them immediately after they gave notice of adding an AF, shredding all docs in the process..

Hmmmmm lets explore...

Ann Minch can qualify as a "least sophisticated consumer" - or at least an unsophisticated consumer - but an attorney knows what a contract is and what's involved. I do not think BOA will budge and I think the judge will laugh in this lawyer's face, even in crazy California...

I just think, in this situation, that he is cutting off his nose to spite his face. He is going to do himself so much damage by doing this. And even if he wins his suit years down the road he still has a ruined credit report so was it all worth it?.

I said earlier that he could opt out of the increase because that way his credit report remains intact, and his account remains open, but when BOA sees this they may close his account out of spite...
