Got a quick question: Can you buy stuff on ebay with debit card thats not Discover Card or visa? Hoping for any comment. My 2nd question... I sent a letter to Citibank asking them not to call and to communitcate be mail only..

Today there was a number that called my phone 7 times. when I answered it, it was Citibank..

I asked for the persons name nd employee #. She gave it to me. I explained to her that they should not be calling me..

She found the letter and apologized. This is not the first time that thye have called after sending the letter..

What are my options here?..

Of course! but... you might want to make sure and wait for another member here to confirm my answer as I am not quite sure. Better yet, why don't you call the Discover Card guys because they can answer you better...

Since we're dealing with the OC, there's not much you can do. Unless your state has specific laws regulating OC contact..

They are not bound by the FDCPA like CA's are...

Could they be bound by the TCPA? Even if OP gave express permission in the Discover credit card contract for the calls to be made, cant she revoke that permission? Seems like a good way to get sued by the OC, though..

I am going to keep pushing questions about the TCPA until someone tells me it would apply to something other than super litigious consumer fairy tales...

Would revoking permission from the OC up the violations from $500-$1,500 under the TCPA (if they keep calling). I had also read some opinions where the courts decided that simply filling out a field on a application of credit that just reads, "Cell Phone -" is not considered express consent. Is this true?.

I will be looking for your threads. Seems that the TCPA is the bite of a great white, while the FDCPA is the bite of a flea..

ACTUAL.

Cases that the TCPA was used against Original Creditors. From reading the TCPA it is geared more towards Telemarketing (CA) calls then anything else..

I do not know about monetary violations, but I know Dolemite is correct about revoking permission as I used that for DM on her Crap One account!..
