If your car was repossessed the original contract was voided by the repossession..
If all the legal requirements of your State on the repossession and subsequent resale were met, (check my website for State repo laws), then a claim for the deficiency could have been brought against you.. The UCC gives a 2 year time frame from the date of the resale to bring any action. Some States only allow 1 year in their Motor Vehicle Finance or State UCC statutes.. You can send the CA a letter stating they have no legal claim to pursue any collection on this account, and that any continued collection activities including reporting to any credit bureaus may be considered grounds for your filing criminal charges against them under your State's laws on fraudulent extortion.. As to the CRAs if the records show your original delinquency in 1996, it should be off your record as being over-age anyway... |

Thank you for the quick responses. Whychat I'm not sure about receiving any paperwork from the repo company. I really can't remember if I did or not. I would have to go back into my files and check through things. But it really does not stand out in my mind that I rec'd any kind of paperwork. Thank you for directing me to your site it was indeed helpful information. The OC that was on there stated the 1995, which has since been deleted due to 7 years. If I cannot find the paperwork that I was suppose to have gotten from the repo company, how should I go about finding out if the repo was legit, or do I not have a leg to stand on?. Kathy.. |

At this point, it doesn't matter if the repo was legit or not. They only had, at MOST, 2 years from the date of the repo, to try and collect on the deficiency created by the sale of the repo'd vehicle. That 2 year time frame would have been over in 1998. If they were going to do anything (such as sue) they would have had to do it before then. They didn't, obviously..
The CA (which one is it, by the way, Arrow?) bought a debt that they KNOW is time-barred from collecting, hoping that they can intimidate you into paying.. Tell them to go whiz up a rope... |

If the original delinquency date was say January of 96, the purge date would be Jan of 03. And for any date after Jan, the purge date would be that month is 2003. So, at this point in time, it can still be reported...
