Got a question, hope someone can answer... Can anyone give me advice on a 2/28 Lending Tree mortgage loan? Thanks for any comment. Another question on my mind: I faxed a validation letter to a CA. they responded 8 hours later with this:.

"In response to your letter we are only required by law to provide you the name address and amount of the original creditor when responding to a dispute. You must follow proper protocol with the credit agency to dispute the bill, unless you can prove it was paid or placed in error. I will not provide you the requested information outside of the federal mandate..

This office reserves the right to to process your account for legal action at any time even during the dispute if our client instructs us to do so.".

Now I know this is wrong, but after I got ticked, I wrote a nasty reply. But before I pull the trigger, should I give them more rope to hang themselves? For instance, it sounds like they might try to serve me w/ judgment.....or try to collect further like pull my CR's (then I'd REALLY have some leverage)..

So should I wait and let them shoot themselves in the foot, or fire off the reply and let them know what I know?..

There is no reason whatsoever to issue a second validation letter..

If they did not comply the first time and you re-send it, you're giving them another chance to get away with their violation. Therefore, the second document they should get from you is a notice of intent to file suit..

To the original poster: The information they've given you about what they need to do to validate is top-rated bullshit, and was in all likelihood written by someone who doesn't have a clue about federal law. They have to show that you have a contractual obligation to pay them. By offering nothing more than a creditor name, a date and a $ amount, they're not even close to proving the debt, and in that case you should not even assert that you paid it. All you should argue is that the debt is not yours until they prove otherwise. Do not acknowledge it in any way whatsoever. Their letter is your written proof of a continued collection activity without validation - a clear FDCPA violation..

Wait your thirty days, send the estoppel letter, then nail them. I agree with the provious poster that the CA's response is crap and they are assuming you dont know your rights. Sit back, relax, then nail them..
